Please read these Terms and Conditions carefully before using the ArcMeow website (the “Site”) or purchasing products from ArcMeow (the “Service”).
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.
1. Intellectual Property
The Service and its original content, features and functionality are and will remain the exclusive property of ArcMeow and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of ArcMeow.
Product outlines referencing world-famous landmark architecture adopt publicly accessible architectural silhouette which falls under public domain intellectual property. All material selection, structural assembly craft, functional design and internal structure of ArcMeow cat houses and cat scratchers are independently original creations developed by our brand. No individual or organization may file infringement claims against ArcMeow merely based on the outer silhouette resemblance to world landmarks.
All product designs, images, and copy on this Site are the property of ArcMeow, and unauthorized reproduction or resale is prohibited.
2. Orders & Payment
We reserve the right to refuse or cancel any order placed for products listed at an incorrect price, or for orders we suspect are fraudulent. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made on our Site. You agree to promptly update your account and other information, including your email address and payment method details, so that we can complete your transactions and contact you as needed.
All payments are processed securely through our licensed payment partners (PayPal, Airwallex). We do not store full credit card information on our servers.
3. Product Information
We strive to display our products (including color, size, texture) as accurately as possible. However, we cannot guarantee that your computer monitor’s display of any color will be completely accurate. We reserve the right to modify product specifications without prior notice, but will not affect the core functionality of products you have already ordered.
Minor variations in handmade or natural material products (including minor texture differences in felt products) are normal and do not constitute quality defects.
4. Returns & Refunds
All returns, refunds and exchanges are subject to our separate Refund & Shipping Policy, which is incorporated into these Terms by reference. By making a purchase, you agree to be bound by the terms of our Refund & Shipping Policy.
5. Prohibited Uses
You may not use the Site:
- For any unlawful purpose or to solicit others to perform unlawful acts
- To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances
- To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate
- To submit false or misleading information
- To upload or transmit viruses or any other type of malicious code
- To scrape, copy, or duplicate any content on the Site for commercial use without our written permission
6. Limitation of Liability
In no event shall ArcMeow, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service or products purchased through the Service.
Our total liability for any claim arising out of or relating to these Terms or your purchase shall not exceed the total amount you paid for the relevant order.
7. Indemnification
You agree to defend, indemnify and hold harmless ArcMeow and its licensees and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees) arising from: your use of and access to the Service; your violation of any term of these Terms; or your violation of any third-party right, including without limitation any copyright, property, or privacy right.
8. Dispute Resolution
All disputes arising out of or relating to these Terms, your use of the Site, or any products purchased from ArcMeow shall be resolved through binding individual arbitration, rather than in court. You waive your right to participate in a class action lawsuit or class-wide arbitration against ArcMeow.
The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA), and the governing law shall be the laws of the State of Delaware, United States, without regard to its conflict of law principles.
9. Modifications
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
